1. General
[a] photo living world images are available for commercial purposes through rights-managed licensing. The terms and conditions of the licensing agreement dictate how, when and where the images are reproduced and distributed.
[b] Rights-managed licences are granted on a per image, per use, per date range basis. We do not grant licences for exclusive rights.
[c] We do not grant licences for exclusive rights.
2. Definitions in these terms and conditions:
[a] photo living world is the trading name of the copyright owner of all the images made available via this website.
[b] client means the person or organisation to whom photo living world address the invoice.
[c] image means photograph and/or digital photographic file including all data contained therein, owned by photo living world.
[d] reproduction means copying and/or publishing and/or storage in any format, of the whole or any part of any image.
[e] copyright is as defined in Copyright, Designs and Patents Act 1988.
3. Copyright
[a] The entire copyright of all images available from photo living world is retained by Bill Taylor and Sally Taylor at all times throughout the world. All rights are reserved.
[b] photo living world supplies these images and sells the right to reproduce them in a given context only. No property or copyright in any image shall pass to the client whether on its submission or to photo living world's grant of reproduction rights in respect thereof.
[c] Bill Taylor and Sally Taylor assert their moral right to be identified as the authors of the images in accordance with sections 77 and 78 of the Copyright, Designs and Patents Act 1988.
[d] Unless otherwise agreed in writing, any image reproduced by the client that omits the copyright notice or credit line specified by photo living world, shall be subject to a 50% increase in the payment due to photo living world for that image.
[e] Reproduction rights granted under license by photo living world are strictly limited to the use and period of time specified on the photo living world invoice.
[f] Reproduction rights granted under license by photo living world are granted to the client only. They are not transferable to any third party under any circumstances.
